    Excellent piece and thanks for giving this issue such a public profile. For too long people have relied on companies to “do the right” thing and inform them if there has been a breach affecting their personal data. However, as we have witnessed from recent debacles many organisations are not treating the data entrusted to them by their clients as seriously as they should.

    Our Data Protection laws are quite strong and all companies storing personal information on individuals must abide by them and ensure they do have the “adequate security measures” in place. But there is nothing to oblige a company to do anything if those measures, be they technical, personnel or process based, fail.

    Mandatory Breach Disclosure will ensure individuals are made aware of when their data is exposed and can take appropriate action. It also ensures that other companies learn from the mistakes others make and can then implement measures to ensure they do not suffer from the same type of breach.

    I have been an advocate of breach disclosure laws for quite a while. I would caution that we need to ensure that whatever laws are introduced are designed in such a way as to not punish companies for taking recognised best practise to protect information. For example, a company that has encrypted their laptops to protect any data on them may be exempt from making a disclosure.

    While it is unfortunate that we have seen so many data loss incidents of late I hope that the silver lining on this particular cloud will be an honest and open debate on the need for breach disclosure laws.
